Gay Marriage In India, Final Court Hearing On November 30

The Delhi high court Monday, listed the final plea on the same sex couples that is Gay Marriage In India, to recognize same-sex marriage act under the special Hindu marriage Act. The bench of Chief Justice D N Patel and justice Jyoti Singh granted time to parties for filing replies and rejoinder. The bench listed it for final. Hearing on November 30. The question still stands in everyone’s mind, Same Sex marriage legal will happen on not?

In the first petition, Abhijit Iyer Mitra and three others have arguments on same sex marriage legal. The petition said that same-sex marriage is not possible even if the Supreme Court decriminalized the act and daughter a declaration to give them a revolution under the Hindu marriage act and special marriage act.

The Couples Who Filed The Petition for Same Sex Marriage Legal

There are two more please filed by two men who are seeking to get married under the SMA and are challenging the provision of the act to the extent that it does not provide for same sex marriage act. The same petition is also filed by two men who got married in the US but when they applied for registration under the foreign marriage act, it was denied.

One more petition is filed to allow a foreign-origin spouse of overseas citizens of India cardholder, where the person can apply for OCI registration regardless of what their sex is. The two men who filed the case both are married in the United States but are unable to register under FMA due to being of the same sex.

The persons who filed the petition are, Joydeep Sengupta an OCI, and Russell Blaine Stephens, who is a US citizen. The other petitioners Rae Mario Dpenha an Indian and a queer right academic who is also OK an activist perusing a Ph.D. at Rutgers University, USA. Karuna Nandy, the advocate appearing from the couple’s side said that they got married in New York and the law that is applicable in their case are the citizenship act, FMA, and SMA.

She further said that the gender identity of the spouse is not mentioned in the act and that a person who is married to an overseas Indian and those whose marriage is registered for more than two years should be eligible for applying for an OCI card. Solicitor General Tushar Mehta mentioned that the term spouse is not defined as husband or wife, and the term marriage is to regard with the heterosexual couples and it was not necessary to file a specific reply for the citizenship act. He also said that there is some misunderstanding regarding the Supreme court’s verdict on decriminalizing homosexual acts.

The case of two women was represented by the advocate Maneka Guruswamy and Lawyers Arundhati Katju, Govind Manoharan, and Surabhi Dhar have said that they are living together for more than 8 years but are unable to get married due to the laws. Not only this they also are not able to have several advantages that the opposite sex marriage get. 

Same-sex marriage is not legalized yet and it is believed to be an institution between man and woman and not between same-sex. The court has given the date for the final hearing of the verdict that will take place on November 30. It is yet to see if Same Sex marriage act can be legalized in India or not.

Now there will be a Final Court Hearing On November 30, which will decide whether the Same Sex Marriage Legal will happen or not?
